How Is the Maintenance Amount Determined?

The amount of maintenance is set by the judge, taking into account the parties' income, the child's needs, the standard of living and the principle of equity. There is no fixed formula. Each case is assessed on its own particular circumstances.

The Amount of Child Support (İştirak Nafakası)

Child support is the contribution of the parent who does not have custody toward the child's expenses. In settled practice, the parent's income, the child's age, education and health expenses, and the family's shared standard of living are assessed together.

Interim Maintenance, Post-Divorce Alimony and Support Maintenance for Relatives

Interim maintenance is temporary protection that applies while the case is pending. Post-divorce alimony protects the spouse who will fall into poverty after the divorce. Support maintenance for relatives is paid to descendants, ascendants or siblings who would otherwise fall into poverty. Each has its own legal basis and its own calculation dynamics. Annual Increase of Existing Maintenance

Maintenance set by court order is increased each year in line with the Turkish Statistical Institute's (TÜİK) domestic producer price index (Yİ-ÜFE) or consumer price index (TÜFE) rates, so that its purchasing power is preserved. How is the maintenance amount determined?

The judge sets the amount of maintenance according to the parties' financial situation, the children's needs and the standard of living. Turkish law has no fixed rate. An equitable amount is determined at the court's discretion in light of the social and economic status investigation (SEDA).

What are the types of maintenance?

Turkish law recognizes four basic types of maintenance: (1) interim maintenance, temporary maintenance paid while the case is pending; (2) child support, paid for the child; (3) post-divorce alimony, for the spouse who will fall into poverty after divorce; and (4) support maintenance for relatives in need.

How is child support determined?

Child support is the contribution of the parent who does not have custody toward the child's expenses. The 2nd Civil Chamber of the Court of Cassation assesses the parent's income, the child's age, education and health expenses, and the family's shared standard of living together. The principle of the best interests of the child is paramount.

When is post-divorce alimony awarded?

Under the Turkish Civil Code (TMK) Art. 175, it may be awarded to the spouse who will fall into poverty because of the divorce and whose fault is the lesser. On 4 June 2026, the Constitutional Court (AYM) annulled the words "indefinitely" in that article. The annulment will take effect 9 months after the reasoned decision is published in the Official Gazette. Until then, the existing rule continues to apply.

What happens if maintenance is not paid?

If a maintenance debt is not paid, enforcement proceedings may be started. In addition, under the Enforcement and Bankruptcy Law (İİK) Art. 344, a person who fails to pay maintenance may be sentenced to coercive imprisonment (disciplinary detention) of up to 3 months. Maintenance receivables also have priority ranking in attachment proceedings.

How do I update my existing maintenance?

If the court order contains an automatic increase clause, the maintenance is increased at each renewal period by the Turkish Statistical Institute's PPI/CPI rates. If there is no automatic increase clause, or if the amount has become insufficient in the face of inflation, an action for a maintenance increase must be filed.
